Turkey's Code of Obligations (Borçlar Kanunu) grants tenants significant protections that many landlords — and tenants — are unaware of.
Annual Rent Increase Cap
Since 2022, annual rent increases for residential tenants have been capped at the 12-month CPI inflation rate. As of mid-2024, this cap is approximately 58% — significant, but still well below the 100–120% increases some landlords attempted in 2022–2023.
Security Deposit
By law, landlords may not demand more than 3 months' rent as a security deposit. Deposits must be returned within 1 month of lease end, less documented deductions for damage beyond normal wear and tear.
Eviction Restrictions
Landlords cannot evict a tenant simply by refusing to renew a lease at the end of its term unless they require the property for personal use, carry out a major renovation requiring the property to be vacant, or the tenant is in breach. Even then, eviction requires a court order — a process that takes 6–18 months in Istanbul.
Tenant's Right to Terminate
Tenants may terminate a fixed-term lease by giving 15 days' written notice before the end of each annual period. Early termination carries liability for up to 3 months' rent.
