Key Definitions
"Platform"The APTHUB website (apthub.com.tr), mobile application, and all related services operated by APTHUB Gayrimenkul Teknolojileri A.Ş.
"User" / "You"Any individual who accesses, browses, registers on, or uses the Platform, including guests, registered members, landlords, and consultants.
"Consultant"A licensed real estate professional or agency that has completed APTHUB's verification process and pays a subscription fee to list properties and use lead generation tools.
"Listing"Any property advertisement — for rent, for sale, shared housing, short-term stay, or commercial — published on the Platform.
"Content"All text, images, videos, documents, and other materials uploaded, submitted, or transmitted through the Platform by Users.
"APTHUB" / "We"APTHUB Gayrimenkul Teknolojileri A.Ş., a company incorporated under Turkish law, with registered office in Beşiktaş, Istanbul.
1 Acceptance of Terms
By accessing or using the APTHUB Platform in any capacity, you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"), along with our Privacy Policy and any additional guidelines or rules applicable to specific features.
Important
If you do not agree to these Terms, you must immediately stop using the Platform. Continued use after any update to these Terms constitutes your acceptance of the revised Terms.
1.1 Eligibility
- You must be at least 18 years of age to create an account or use the Platform's transactional features.
- If you are accessing the Platform on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.
- The Platform is intended for use within the territory of Turkey; access from outside Turkey is permitted but local laws of your jurisdiction may also apply.
1.2 Language
These Terms are provided in Turkish and English. In the event of any inconsistency or conflict between the Turkish and English versions, the Turkish version shall prevail, as this is the governing language under Turkish law.
2 User Accounts
Certain features of the Platform require registration. When you create an account, you agree to the following obligations:
2.1 Account Registration
- You must provide accurate, current, and complete information during registration and keep it up to date.
- You may not use another person's identity, create false identities, or misrepresent your affiliation.
- One person or entity may only maintain one active account. Duplicate accounts may be suspended without notice.
- Consultant accounts require additional verification: valid real estate licence (Tapu ve Kadastro Genel Müdürlüğü registration) and T.C. Kimlik or business registration number.
2.2 Account Security
- You are solely responsible for maintaining the confidentiality of your password and all activity that occurs under your account.
- You must notify APTHUB immediately at security@apthub.com.tr upon discovering any unauthorised use of your account.
- APTHUB will not be liable for losses resulting from unauthorised account access caused by your failure to secure your credentials.
2.3 Account Suspension and Termination
APTHUB reserves the right to suspend, restrict, or permanently terminate any account at its sole discretion, including (but not limited to) accounts that:
- Violate any provision of these Terms.
- Engage in fraudulent, misleading, or harmful activity.
- Fail to pay outstanding subscription or service fees within 14 days of the due date.
- Remain inactive for more than 24 consecutive months.
You may delete your own account at any time via Settings → Account → Delete Account. Upon deletion, your listings will be unpublished, and personal data will be handled per our Privacy Policy.
3 Listing Rules
All Listings on APTHUB must comply with Turkish law and our community standards. By submitting a Listing, you represent and warrant that:
3.1 Accuracy Requirements
- All information in the Listing (price, size, location, features) is accurate, truthful, and not misleading.
- Photos must depict the actual property being listed — stock photos or images of different properties are not permitted.
- The property must be available for the purpose stated (rental, sale, short-term, etc.) at the time of listing.
- Prices must be stated in Turkish Lira (₺) as the primary currency, per Turkish legal requirements.
3.2 Ownership and Authorisation
- You must own the property or have written authorisation from the owner to list it.
- Consultants listing on behalf of property owners must hold a valid agency agreement (vekâletname or yetki belgesi).
- Short-term rental listings must comply with applicable Turkish regulations including the Turizm Tesisleri Yönetmeliği and municipal short-term rental rules where applicable.
Listing Review
APTHUB reserves the right to review, edit, or remove any Listing at any time without notice if it is found to violate these rules or applicable law. Repeated violations may result in permanent account suspension.
3.3 Content Licence
By submitting a Listing, you grant APTHUB a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute your Listing content for the purposes of operating and promoting the Platform. You retain ownership of your content. This licence terminates when your Listing is removed.
4 Prohibited Activities
The following activities are strictly prohibited on the APTHUB Platform. Violation may result in immediate account termination and may be reported to relevant Turkish authorities:
Zero-Tolerance Violations
- Fraudulent listings, scam properties, or advance-fee fraud (dolandırıcılık).
- Listing properties you do not own or have no authority to list.
- Collecting payments or deposits outside the Platform for fraudulent purposes.
- Impersonating APTHUB staff, consultants, or other users.
- Discrimination based on race, religion, nationality, gender, or any other protected characteristic under Turkish law.
4.1 General Prohibitions
- Reverse engineering, scraping, or automated data collection from the Platform without written consent.
- Uploading malware, viruses, or any code designed to disrupt the Platform.
- Circumventing access controls, subscription paywalls, or security mechanisms.
- Using the Platform for money laundering or any activity prohibited under Turkish Criminal Code (TCK).
- Publishing spam, chain messages, or unsolicited commercial communications to other users.
- Creating listings for properties that do not actually exist ("ghost listings") to generate false leads.
- Manipulating review or rating systems with fake reviews.
4.2 Reporting Violations
If you encounter a listing or user you believe is violating these Terms, use the "Report" button on any listing or profile, or email trust@apthub.com.tr. APTHUB investigates all credible reports and responds within 3 business days.
5 Payment Terms
APTHUB is free for property seekers. Consultants and landlords who wish to access premium features are subject to the following payment terms:
5.1 Consultant Subscription Plans
- Basic Plan (Ücretsiz): Up to 3 active listings, standard placement. Free.
- Pro Plan: Unlimited listings, featured placement, analytics dashboard, lead management tools. Monthly or annual billing.
- Agency Plan: All Pro features plus team accounts, API access, branded profile page, and dedicated account manager. Custom pricing.
5.2 Billing and Invoicing
- All prices are listed in Turkish Lira (₺) and include VAT (KDV) at the applicable rate.
- Subscription fees are billed in advance on a monthly or annual basis.
- Invoices (e-fatura or e-arşiv fatura) are issued automatically and accessible in your dashboard.
- Payment methods accepted: Turkish bank cards (Visa, Mastercard, TROY), bank transfer (EFT/Havale), and digital wallets where available.
Refund Policy
Monthly subscriptions are non-refundable once the billing period has begun. Annual subscriptions may be refunded on a pro-rata basis within the first 14 days of purchase, minus a processing fee of ₺150. Refund requests must be submitted to billing@apthub.com.tr.
5.3 Late Payment and Suspension
- Failed payments trigger an automatic retry after 3 days. If the second attempt fails, a grace period of 7 days is granted.
- After 14 days of non-payment, the account is downgraded to the free tier and active paid listings may be paused.
- Accounts suspended for non-payment may be reactivated by settling the outstanding balance plus a ₺50 reactivation fee.
6 Limitation of Liability
APTHUB operates as a marketplace intermediary. We facilitate connections between property seekers, landlords, and consultants but are not a party to any rental, sale, or service agreement between Users.
6.1 Platform Disclaimer
- The Platform and all Content are provided "as is" without warranties of any kind, express or implied.
- APTHUB does not verify the accuracy of every listing detail, nor guarantee the quality, legality, or fitness of any property.
- We do not guarantee continuous, uninterrupted access to the Platform. Scheduled maintenance and unforeseen outages may occur.
6.2 Transactions Between Users
- APTHUB is not responsible for any agreement, payment, deposit, or dispute arising directly between Users.
- Property seekers are strongly advised to verify ownership documents (tapu), inspect properties in person, and use licensed consultants for significant transactions.
- APTHUB is not liable for losses incurred due to fraudulent listings or misrepresentations by third-party users. If you suspect fraud, report it immediately via trust@apthub.com.tr.
Cap on Liability
To the maximum extent permitted by Turkish law, APTHUB's total aggregate liability to any User shall not exceed the greater of: (a) the total fees paid by that User to APTHUB in the 12 months preceding the claim, or (b) ₺500. APTHUB shall not be liable for any indirect, incidental, special, or consequential damages.
6.3 Force Majeure
APTHUB shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, acts of war, cyberattacks, government orders, or infrastructure failures by third-party providers.
7 Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
7.1 Jurisdiction
- Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Enforcement Offices.
- Consumer disputes may also be referred to Consumer Arbitration Committees (Tüketici Hakem Heyeti) for claims within statutory monetary limits under Turkish Consumer Protection Law (Law No. 6502).
Informal Resolution First
Before initiating any legal proceedings, we encourage you to contact us at legal@apthub.com.tr. APTHUB commits to attempting good-faith resolution of disputes within 30 days of written notice.
7.2 Applicable Turkish Laws
- Turkish Code of Obligations (TBK) — Law No. 6098, governing contracts.
- Turkish Commercial Code (TTK) — Law No. 6102.
- Consumer Protection Law — Law No. 6502.
- Electronic Commerce Law — Law No. 6563.
- KVKK — Law No. 6698 (data protection, covered in Privacy Policy).
8 Changes to Terms
APTHUB reserves the right to modify these Terms at any time to reflect changes in our services, business practices, or applicable law.
8.1 Notification of Changes
- Material changes (e.g., new payment obligations, changes to user rights) will be notified by email and via a prominent in-app banner at least 30 days before taking effect.
- Minor changes (e.g., clarifications, typographical corrections) will be reflected in the "Effective Date" at the top of this page without advance notice.
- A version history is available upon request at legal@apthub.com.tr.
8.2 Your Options
If you disagree with a material change to these Terms, you may close your account before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
